We were told by our e-cigarette attorney that we cannot proceed with the case unless we obtained funds. In order to obtain a settlement from our client, we had to prove the maker of Brightpearl’s e Cigarettes, namely, Brightpearl E-Cigarettes and Brightpearl LLC, mis told us they had authorization to market and sell e-Cigarettes in the state of Florida. The company’s attorney also told us that if we didn’t settle the case in hawaii of Florida they would file a federal lawsuit against us and our company for patent infringement and violation of trade secrets.

This was as the court discovered that the parties were not in a position to reasonably negotiate a fair and reasonable settlement out of court.
